§1. INTRODUCTION

1.1. These Terms and Conditions define the rules and conditions under which the Subscriber uses the Newsletter service.

1.2. The content, graphic elements, and other components of the Newsletter are subject to copyright or other intellectual property rights held by the Service Provider or third parties and are legally protected. By entering into a Newsletter service agreement with the Service Provider, the Subscriber does not acquire any rights or licenses to the intellectual property contained in the Newsletter.

1.3. Use of the Newsletter service is free of charge. However, the Subscriber is responsible for any Internet access or data transmission costs charged by their telecommunications provider, according to that provider’s pricing and terms.

1.4. The Service Provider may terminate the Newsletter service, or change its subject matter or frequency, at any time.

1.5. The Newsletter is sent at a frequency determined by the Service Provider.

§2. DEFINITIONS

2.1. Terms and Conditions – this document.

2.3. Subscriber – a natural person, legal person, or organizational unit without legal personality but with legal capacity, who uses the Newsletter service under these Terms and Conditions.

A natural person may be a Subscriber if they:

(a) have full legal capacity; or

(b) have obtained consent from a legal guardian if their legal capacity is limited; or

(c) are represented by a legal guardian if they have no legal capacity.

2.4. Website – a group of web pages and other documents made available by the Service Provider under the domain www.livedguides.com.

2.5. Form – a web page within the Website that enables the Subscriber to subscribe to the Newsletter service.

2.6. Online Tools – software and the Form made available on the Website to order and use the Newsletter service, as well as Deactivation Links allowing the Subscriber to unsubscribe.

2.7. Deactivation Link – a hyperlink received by the Subscriber in an email from the Service Provider, enabling the Subscriber to unsubscribe from the Newsletter by activating the link.

2.8. Newsletter – a collection of information sent by the Service Provider to the Subscriber’s provided email address, containing informational, promotional, or advertising content about the Service Provider or third parties.

§3. CONDITIONS OF USE

3.1. Subscription and unsubscription are carried out via the Online Tools.

3.2. To subscribe, the Subscriber must fill out the Newsletter Form and send it to the Service Provider by clicking the subscription button.

3.3. By confirming the subscription, the Subscriber declares that:

3.3.1. the data provided in the Form is true and belongs to them;

3.3.2. they have read the Service Provider’s Privacy Policy.

3.4. The Service Provider reserves the right to verify the Subscriber’s data.

3.5. Providing an email address is voluntary but required to receive the Newsletter.

3.6. The email address will be processed by the Service Provider solely for Newsletter delivery. With the Subscriber’s consent, it may also be shared with third parties for direct marketing. Consent can be withdrawn at any time without affecting prior lawful processing.

3.7. The Service Provider is the data controller of the Subscriber’s personal data.

§4. SUBSCRIBER STATUS

4.1. The Service Provider makes every effort to ensure the Newsletter service is accessible to users with up-to-date browsers, operating systems, and email clients, but does not guarantee compatibility with all configurations. Some browser settings (e.g., blocking images) may affect display.

4.2. Internet-related risks are described in the “Privacy Policy” available on the Website.

4.3. The Newsletter service agreement is concluded for an indefinite period.

4.4. The Subscriber may unsubscribe at any time using the Deactivation Link provided in each Newsletter email.

§5. LIABILITY AND RIGHTS OF THE SERVICE PROVIDER

5.1. The Service Provider is not liable for:

5.1.1. interruptions caused by maintenance, upgrades, or events beyond its control (force majeure, third-party actions);

5.1.2. content from third parties;

5.1.3. data loss due to hardware or software failures;

5.1.4. service issues caused by telecom or power providers;

5.1.5. damages resulting from incorrect or unlawful use by the Subscriber or from false data provided by the Subscriber.

5.2. The Service Provider may terminate the Newsletter service with 7 days’ notice if the Website or Newsletter service is discontinued.

5.3. The Service Provider may refuse service for security reasons or where required by law.

5.4. The Service Provider reserves the right to:

5.4.1. update or modify the Newsletter software;

5.4.2. change the layout or design of web pages;

5.4.3. expand or alter the forms or scope of the Newsletter service without prior notice.

5.5. In case of a breach of law or these Terms, the Service Provider may suspend the service after notifying the Subscriber and allowing at least 3 days for explanation or correction.

5.6. Immediate termination without notice may occur if:

5.6.1. the Subscriber withdraws consent to personal data processing;

5.6.2. the legal guardian’s consent for representation is withdrawn;

5.6.3. false personal data was provided;

5.6.4. the Subscriber unsubscribes from the service.

§6. COMPLAINT PROCEDURE

6.1. Complaints regarding the Newsletter may be submitted via email to: hello@livedguides.com

6.2. The Service Provider will respond within 30 days of receiving the complaint.

6.3. If the complaint lacks necessary information, the Subscriber may be asked to supplement it within at least 7 days. Failure to do so may result in the complaint being dismissed.

6.4. The Service Provider’s response will be sent to the Subscriber’s email address provided in the Form.

§7. AMENDMENTS TO THE TERMS

7.1. These Terms and Conditions take effect upon publication on the Website.

7.2. The Service Provider reserves the right to modify these Terms. Subscribers will be notified of any changes via the Website and through a Newsletter message containing a summary of the updates, at least 14 days before the changes take effect.

7.3. The revised Terms become effective no earlier than 14 calendar days after notification unless the Subscriber unsubscribes within that period.

7.4. The Terms and Conditions are available free of charge on the Website in a format that allows downloading, saving, and printing.
